Terms of Service

Please read these Terms carefully before using Perk.Cards. By accessing or using our API, website, or any of our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
1. About the Service
Perk.Cards operates the Card Intelligence Engine — a platform that aggregates publicly available credit card product data from financial institution websites, processes it using AI, and publishes it via a public API for informational purposes. Our services include a public REST API for querying published credit card data, card search and comparison tools, an admin platform for managing data sources, and this website.
2. Acceptance and Eligibility
By using our services you confirm that you are at least 18 years old, have the legal capacity to enter into these Terms, your use complies with all applicable laws and regulations, and you are not accessing the service from a jurisdiction where such services are prohibited.
3. API Usage and Acceptable Use
3.1 Permitted Use
You may use our public API to display card information in your own applications, build comparison tools and recommendation engines, research credit card product trends, and develop products that help consumers make informed card choices.
3.2 Prohibited Use
You must NOT: represent our data as your original research or real-time bank data, use our data to mislead consumers about card fees or benefits, reproduce card data in bulk for resale as a competing data product, circumvent or disable rate limiting or security measures, use automated bots to scrape our API beyond normal application usage, use the service to process or store personal financial data of individuals, or attempt to access admin endpoints or unpublished data.
3.3 Rate Limiting
Our public API is provided free of charge and may be subject to rate limiting. Excessive use that impacts service availability for other users may result in temporary or permanent access restrictions without notice.
4. Data Accuracy Disclaimer
Credit card terms, fees, and benefits change frequently. Our data is sourced from publicly available webpages and processed by AI. While we strive for accuracy: data may not reflect the most current card terms — always verify with the issuing bank; AI extraction may contain errors or omissions; we are not a financial institution, credit bureau, or regulated financial service; nothing on this platform constitutes financial advice or a recommendation; and we are not liable for decisions made based on data from this platform.
5. Intellectual Property
5.1 Our Platform
The Card Intelligence Engine — including our extraction methodology, AI prompts, admin platform, API design, and all software — is the intellectual property of Perk.Cards. You may not copy, reproduce, or create derivative works of our platform.
5.2 Card Data
Individual facts about credit card products are not copyrightable. However, our structured, AI-extracted, curated compilation of this data constitutes a database with protectable interests. Bulk extraction or reproduction of our compiled dataset is prohibited.
5.3 Third-Party Trademarks
Card names, bank names, network logos, and related marks are the property of their respective owners. We reference them for factual identification only — this does not imply any endorsement or partnership.
6. Admin Platform
Access to the admin platform (/admin) is restricted to authorised Perk.Cards personnel. Unauthorised access attempts are a violation of these Terms and may constitute a criminal offence under applicable computer fraud laws including the Computer Fraud and Abuse Act (US) and Computer Misuse Act (UK).
7. Webhooks and API Integrations
If you register to receive webhook events from our platform, you must verify the HMAC-SHA256 signature on every inbound webhook. Your webhook endpoint must respond within 30 seconds to avoid retry loops. You are responsible for idempotent handling of webhook events. We are not liable for data delivered via webhook that you fail to verify.
8. Availability and Service Changes
We make commercially reasonable efforts to maintain service availability but make no uptime guarantees. We reserve the right to modify, suspend, or discontinue any part of the service with or without notice, remove or update card data at any time, change API endpoints or rate limits, and terminate access for users who violate these Terms.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERK.CARDS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED £100 (OR EQUIVALENT IN LOCAL CURRENCY).
10. Indemnification
You agree to indemnify and hold harmless Perk.Cards and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service in violation of these Terms, any content or data you submit through the service, or your violation of any applicable law or third-party rights.
11. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales, unless prohibited by applicable consumer protection law in your jurisdiction. Before initiating legal proceedings, you agree to contact us at legal@perk.cards to attempt resolution in good faith.
12. Changes to These Terms
We may update these Terms. We will note the revised effective date at the top of this page. Material changes will be communicated via the platform homepage. Continued use after changes constitutes acceptance of the updated Terms.
